During that time the enforcement agency under CASL, the Canadian Radio-television and Telecommunications Commissioner (CRTC), has been actively investigating and administering the law. In fact, one sender has already received a fine of $1.1 million dollars.     CASL prohibits, amongst other things, the:

    • sending of commercial electronic messages without the recipient’s consent, including messages to email addresses and social networking accounts, as well as text messages sent to a cellphone;
    • collection of electronic addresses by the use of computer programs or the use of such addresses, without consent (address harvesting); and
    • provision of false or misleading information either in the content of a message or in sender information.
